This policy explains how the photographer, Luke Le Prevost, uses personal information to fulfil primary services of photography of subjects for publicity and/or arranged commissions.
LLP Photography & Creative is the brand used to market the services and products (photographs) created by the photographer.
What personal information do I collect and for what purpose:
The following personal information is collected for the relevant reasons.
Contact information (which may include name, home/business address, email address or phone number)
This is primarily used to communicate with clients or persons to arrange shoots/commissions or answer queries. An email address may be required to access certain galleries on the ShootProof website, which will also be used in a record of visitors. It is also required to access certain features within ShootProof, including marking favourite pictures, adding products to a shopping basket or making purchases.

This is collected through PayPal payment services or any other bank transaction in order make payment for products or photographer services.

Visual identity may be considered personal information. This is primarily collected through photographing individuals to fulfil a commission or service. Photographs that include visual identities may be used to promote services and the brand through social media.
Storing and protecting personal information:
All personal information is securely stored and organised either in digital files on the photographer’s protected devices (i.e. computer, mobile phone) or printed in paper format.
Personal information will be retained for a maximum of 3 years from the date it was supplied or last used for communication (i.e. contact information), unless the owner of such data requests for it to be deleted. When personal information is disposed, digital files containing this data will be thoroughly deleted and printed paper copies will be shredded. Either process is to ensure the data cannot be recovered.
Using cookies:
The cookies we use do not directly identify users of the website. Cookies are a small block of data stored on a user's device used to ensure this website functions correctly and analyse how user interaction and behaviours (which may include device type, journey and link clicks).
These cookies will not be placed on a user's device unless the user accepts to receive them.

In almost all circumstances, you are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

Exemptions for the public interest:
It may not be necessary to seek consent from individuals who are visually identified in photographs taken when such photographs have the purpose for journalism or an artistic, literary or academic purpose and the public interest in it's publication outweighs the significant interests of the data subject. (for example: photographs showcasing the public participating in a public event or display)
Schedule 8, General Exceptions and Exemptions [2], of the Data Protection (Bailiwick of Guernsey) Law, 2017, may permit this. However it is the photographers practice to seek consent of subjects to be photographed whenever possible and to only exercise this right of exemption when it is not viable or practical to seek consent from individuals, and the publication of material obtained this way would not significantly impact anyone visually identified. The photographer will take serious discretion in all cases.
Event organising groups or individuals may be able to advise the safety risks (such as emotional distress) to utilising this exemption if it’s evident an event will be attended by vulnerable individuals (such as, but not limited to, young children).
Individuals who discover photographs published to the public which clearly identifies themselves or are the primary subject in which they haven’t consented to be photographed for, they may request for such material to be deleted. They can also do this on the behalf of another individual (such as a close relative or acquaintance) providing they have legal authority to do so.

Personal information shared with a third party:
Contact information and payment information will not be shared with any third party without consent of the owner.
Photographs may be shared with trusted third parties (which may include organising committees, the media or significant contributors to the event/subject) for any of the following reasons:
• An agreement was made to share photographs with selected third parties to be used in their own publicity or records
• The photography shoot is on commission by an organisation/company which the photographs will be shared with
• The value of the photographs has public interest in it’s publication
• The photography shoot is on commission by an organisation/company which the photographs will be shared with
• The value of the photographs has public interest in it’s publication
Any photograph shared in this circumstance will only be done if it’s strongly evident sharing any subject’s visual identity would not cause distress to the subject and is legal to do so. Any decision to share photographs will be made at the photographer’s discretion.
The ownership of any shared photographs will be retained by the photographer unless an agreement to pass or share ownership is made. Such agreements must be made in writing.
Use of third party software/applications:
The Store, used for the primary purpose to exhibit and sell products by the photographer, is hosted on the ShootProof ecommerce web platform. ShootProof does have it’s own Terms of Use [3] and Privacy Policy [4] which site users are required to accept.
PayPal is used to process and complete financial transactions in order for customers to make purchases of products on ShootProof, and also have their own Privacy Policy [5]

You can also complain to The Office of the Data Protection Authority (ODPA) if you are unhappy with how we have used your data.
